ClipEmber Terms of Service
Effective August 13, 2026. These Terms govern the ClipEmber web application at clipember.com and the ClipEmber API. See also our Privacy Policy.
1. This agreement
These Terms of Service are a binding agreement between you and ClipEmber, the operator of ClipEmber (“ClipEmber”, “we”, “us”), based in Ukraine. By creating an ClipEmber account, using clipember.com, or calling the ClipEmber API, you accept these Terms and the ClipEmber Privacy Policy, which is part of them. If you do not agree, do not use ClipEmber. If you accept on behalf of a company, you confirm you may bind it.
2. What ClipEmber does
ClipEmber takes a long video that you upload or link, transcribes it, scores candidate moments, cuts them into short vertical clips, reframes them around the speaker, burns word-level captions in, and lets you edit, download, schedule and publish those clips to social accounts you connect. Features are described on clipember.com; the ones live today are the ones you can see in your account.
3. Eligibility
You must be at least 18 years old and legally able to enter this agreement to use ClipEmber. You may not use ClipEmber if you are barred from doing so under the laws that apply to you, or if a platform you connect has banned you.
4. Your account
- Give accurate account details and keep your email address current — we use it for service notices.
- You are responsible for everything that happens under your account, including activity through ClipEmber API keys you generate. Keep API keys secret; rotate or delete them in Settings if exposed.
- One person or organisation per account. Do not share credentials or resell access to your ClipEmber account.
- Tell us at hello@clipember.com if you suspect unauthorised use.
5. Your content and the rights you grant
Your content stays yours. Every source video you submit and every clip ClipEmber renders from it belongs to you. You grant ClipEmber only the limited, worldwide, royalty-free licence needed to run the service for you: to download or receive the video, store it, transcribe it, cut, reframe, caption and render it, keep the results available in your account, and transmit a clip to a platform when you tell us to publish it. This licence exists solely to operate ClipEmber, ends when you delete the content or your account, and does not let us publish, license, sell or train models on your content.
You represent that you own or have permission to use every source you submit — the footage, the music, and the likeness of anyone appearing in it — and that clipping and publishing it breaks no law or third-party right. Public availability of a video (for example on YouTube) is not permission to repurpose it. ClipEmber is a tool; you decide what to feed it and what to publish, and you carry the copyright responsibility for both.
We will remove content in response to a valid copyright complaint and may terminate repeat infringers. Send complaints to hello@clipember.com with the work, the ClipEmber URL, and your contact details.
6. Acceptable use
You agree not to use ClipEmber to:
- process or publish content that is illegal, infringing, sexually explicit, exploitative of minors, hateful, harassing, or that promotes violence, self-harm or dangerous acts;
- create misleading synthetic media of real people, or content that impersonates someone or a brand, including ClipEmber itself;
- spam, engage in coordinated inauthentic behaviour, or artificially inflate engagement on any platform;
- break, overload, probe or circumvent ClipEmber’s limits or security (including scraping, credential stuffing, or bypassing credit accounting);
- reverse engineer ClipEmber, or use it to build a competing clipping service; or
- upload malware, or content containing other people’s personal data you have no right to process.
7. Publishing to connected platforms
Connecting TikTok, YouTube or Instagram is optional. When you connect one, you authorise ClipEmber — through that platform’s official API and its own consent screen — to publish clips on your behalf. ClipEmber publishes only what you queue: a clip you press Post on, or a clip that reaches a slot in a schedule or automation rule you created and can pause or delete at any time.
- Your use of each platform stays governed by that platform’s own terms and community guidelines, in addition to these Terms. Content that breaks their rules is your responsibility, and they may remove it or restrict your account regardless of ClipEmber.
- ClipEmber is an independent product, not affiliated with, endorsed by or sponsored by TikTok, YouTube/Google or Instagram/Meta. Their names and logos belong to them.
- Platforms restrict what an app can do before it completes their review. While a platform integration is unaudited, uploads may need to be finished by you in the platform app, or be visible only to you, and only accounts registered with that platform as testers may be able to connect. ClipEmber shows the current state on the Connections page.
- Platforms can change, throttle or revoke API access at any time. If that breaks a publishing path, ClipEmber will keep letting you download your clips and publish them manually.
- You can disconnect any account at any time in Connections, or revoke access from the platform’s own settings — see the Privacy Policy.
Exactly which permissions ClipEmber asks for, and what it does with them:
TikTok — permissions requested: user.info.basic, video.upload, video.publish, video.list
user.info.basic— read only your TikTok open id, display name and avatar image URL, so the Connected accounts and Calendar screens can show you which account a clip will go to before you confirm it.video.upload— upload one rendered clip that you selected to your own TikTok account. TikTok then sends a notification to your Inbox, you tap it in the TikTok app, and the editing and posting happen there — we cannot publish it for you. This is the only TikTok path in use today, so the final publishing decision always stays inside TikTok.video.publish— post a clip you already queued straight to your profile, so you do not have to finish every post by hand (TikTok calls this Direct Post). We ask for this permission, but it is NOT in use today: TikTok approved the app itself on 18 August 2026, and the separate Direct Post audit that would allow public posts is still under review (we applied on 13 August 2026). We tested it on 26 August 2026 and TikTok refused the post, which is how we know the audit has not landed yet. Until it does, every TikTok clip is uploaded and TikTok notifies you in your Inbox — you tap that notification and post it yourself in the app. When the audit does land, direct posting will apply only to clips where you picked the audience yourself, on the Post to TikTok screen or the TikTok queue screen; there will be no saved default and nothing will be inherited, so a new clip always arrives without a choice and waits for you to make one.video.list— read back the public view, like, comment and share counts of the clips you published through us, so the app can show you how each clip performed and improve which moments it picks next time.- ClipEmber does not read your direct messages, followers list, private analytics or advertising data, or post anything to your TikTok profile at all — today every TikTok clip is uploaded and TikTok notifies you in your Inbox, and the post itself happens only when you tap that notification and post inside the TikTok app.
YouTube — permissions requested: youtube.upload, youtube.readonly
youtube.readonly— read your channel id and channel title, so you can see which channel is connected.youtube.upload— upload the clips you chose to publish to that channel.- ClipEmber does not read your watch history, subscriptions, comments or channel analytics.
Instagram — permissions requested: instagram_business_basic, instagram_business_content_publish, instagram_business_manage_insights (Instagram Login) — or instagram_basic, instagram_content_publish, pages_show_list, pages_read_engagement, business_management (Facebook Login)
instagram_business_basic / instagram_basic + pages_show_list— read your Instagram professional account id and username (and the linked Facebook Page id) to show which account is connected.instagram_business_content_publish / instagram_content_publish— publish the Reels you chose to publish to that account.instagram_business_manage_insights— read back the views, likes and comments of the Reels we published for you — nothing else. Two things use it: the Analytics screen, so you can see how a clip did, and the scoring model, which compares what it picked against what people actually watched and gets better at picking next time. We read only media we published through ClipEmber.- ClipEmber does not read your feed, followers, direct messages, or the insights of posts you made outside ClipEmber.
For TikTok specifically: ClipEmber uses TikTok Login Kit and the Content Posting API in inbox-upload mode. A clip you selected is uploaded to your own TikTok account, TikTok puts a notification in your Inbox, and you finish publishing it yourself inside the TikTok app by tapping that notification. The clip does not appear in your Drafts folder and nothing is posted until you complete that step. We have asked TikTok to approve video.publish (Direct Post) so that a clip you already queued and approved can go to your profile without that manual step; it stays switched off until TikTok both approves the permission and completes its Content Posting audit, because until then posts made by unaudited apps are restricted to private viewing. Separately, video.list lets us read the public view, like, comment and share counts of clips you published through ClipEmber, which is what powers the performance figures you see and how the app learns which moments to pick. By connecting TikTok you also agree to TikTok’s own Terms of Service and Community Guidelines, and you confirm you hold the rights to the video you upload. Revoking access in TikTok, or disconnecting in ClipEmber, stops all future uploads and stops us reading those counts immediately; anything already uploaded to your TikTok account stays with you, under your control.
8. Credits, plans and payments
- ClipEmber metering is credit-based: one credit covers one video up to 20 minutes. Processing consumes the credit when a job starts; a job that fails for a fault on our side is re-queued without charging you again.
- Free credits (including sign-up, referral and promotional credits) are a courtesy, have no cash value, are not transferable, and may expire or be withdrawn if abused.
- Paid credit packs and subscription plans, where offered, are shown with their price before you buy. Payments are processed by Stripe under Stripe’s terms; ClipEmber never receives your card number. Prices exclude taxes unless stated; you are responsible for any tax that applies to you.
- Subscriptions renew for the same period until you cancel. Cancel any time in Settings → Billing; you keep access until the end of the paid period. Except where the law gives you a refund right, payments for delivered processing are non-refundable — but if something went wrong on our side, write to us and we will make it right.
- We may change prices for future periods with at least 14 days’ notice by email.
9. Referrals
ClipEmber may offer a referral programme. Rewards are granted only for verified, genuine activity; self-referrals, fake accounts and other manipulation void the reward and can close your account. ClipEmber may adjust or end the programme prospectively.
10. API and rate limits
The ClipEmber API is part of the service and these Terms cover it. Keep your keys secret, respect the documented rate limits, do not use the API to mirror or resell ClipEmber, and expect breaking changes to be versioned and announced. We may throttle or suspend a key that threatens the service’s stability.
11. Intellectual property
ClipEmber’s software, pipeline, design, caption templates, documentation, name and logo belong to ClipEmber. These Terms grant you a licence to use the service, not to copy, resell or create derivative works from it. If you send us feedback or ideas, you allow us to use them without obligation; we will not claim anything you consider confidential — so mark it, or do not send it.
12. AI output
ClipEmber uses automated systems to choose moments, transcribe speech, and suggest titles, hashtags, summaries and translations. These outputs are suggestions and can be wrong: transcripts can mishear, scores are heuristics, and translations can drift. Review anything before you publish it. ClipEmber makes no promise that a clip will perform, go viral, or reach any number of views.
13. Availability and changes to the service
ClipEmber aims for continuous availability but offers no uptime guarantee. Processing times depend on video length and queue depth. We may add, change, or remove features, and we may run features labelled alpha/beta that are less stable — those are provided for you to try, not to depend on. We give notice of changes that materially reduce a paid feature you rely on.
14. Disclaimers
ClipEmber is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including merchantability, fitness for a particular purpose, and non-infringement. ClipEmber does not warrant that the service will be uninterrupted or error-free, that clip selection will suit your audience, or that a connected platform will accept every upload. Nothing here excludes a warranty that the law does not allow us to exclude.
15. Limitation of liability
To the maximum extent the law allows, ClipEmber and ClipEmber are not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost revenue, lost audience, lost data or the cost of substitute services, even if we were told such damages were possible. Our total liability for all claims relating to ClipEmber in any 12-month period is limited to the greater of the amount you paid ClipEmber in that period or USD 50. Because media is retained for a limited window (see the Privacy Policy), keep your own copies of anything important — ClipEmber is not a backup service. These limits do not apply to liability that cannot be limited by law.
16. Indemnity
You agree to defend and indemnify ClipEmber and ClipEmber against claims, damages and reasonable costs arising from content you submitted or published through ClipEmber, your breach of these Terms, or your violation of a third party’s rights or a platform’s rules.
17. Suspension and termination
You can stop using ClipEmber at any time and delete your account in Settings → Account. We may suspend or terminate an account that breaches these Terms, creates legal risk, abuses credits or rewards, or endangers the service — normally with notice, and immediately where the risk requires it. On termination your licence to use ClipEmber ends; sections 5 (your representations), 11, 14, 15, 16 and 19 survive. Data handling after termination follows the Privacy Policy.
18. Changes to these Terms
We may update these Terms. The effective date at the top changes, and for material changes we email account holders in advance. Using ClipEmber after the effective date means you accept the updated Terms; if you do not, stop using the service and delete your account.
19. Governing law and disputes
These Terms are governed by the laws of Ukraine, without regard to conflict- of-law rules, and the courts of Ukraine have jurisdiction over disputes — except where consumer-protection law in your country of residence gives you the right to bring a claim locally, which we do not take away. Before filing anything, please write to hello@clipember.com: most issues are settled in one email.
